Tide Electrical Solutions - Terms & Conditions
1. Introduction
These Terms and Conditions ("Terms") govern the provision of services by Tide Electrical Solutions ("Company," "we," "us," "our") to the Client ("Client," "you," "your"). By engaging our services, you agree to be bound by these Terms.
2. Scope of Work
The Company shall provide electrical contracting services for domestic, commercial, and industrial projects as specified in the agreed-upon contract or quotation.
All work will be carried out in accordance with applicable laws, regulations, and industry standards.
Any changes to the scope of work must be agreed upon in writing by both parties.
3. Quotations and Pricing
All quotations are valid for 30 days from the date of issue unless otherwise specified.
Prices quoted are based on the information provided by the Client and are subject to change if additional work is required.
Any variation in work or additional services requested by the Client may incur additional charges, which will be communicated and agreed upon before the work proceeds.
4. Payment Terms
A deposit may be required prior to the commencement of work, as outlined in the quotation.
Payment terms will be outlined in the quotation or contract. Final payment is due upon completion of the work unless otherwise agreed.
Late payments may incur interest at the rate of 2% over base per month, calculated daily, until payment is made in full.
The Company reserves the right to cease work if payment is not received according to the agreed terms.
5. Client Obligations
The Client must provide access to the premises and ensure that the site is safe and free from hazards.
The Client is responsible for obtaining any necessary permissions, permits, or approvals required for the work.
The Client must ensure that all necessary utilities (electricity, water, etc.) are available to facilitate the work.
6. Warranties and Guarantees
The Company warrants that all work will be performed with reasonable skill and care.
The Company offers a warranty on workmanship for a period of 1 year from the date of completion.
Any defects or issues arising from the Client’s misuse or unauthorized modification of the work will not be covered under this warranty.
7. Health and Safety
The Company will adhere to all applicable health and safety regulations while performing work on the Client’s premises.
The Client agrees to provide a safe working environment for our staff and contractors.
8. Limitation of Liability
The Company will not be liable for any indirect, incidental, or consequential damages arising from the provision of services.
The Company’s total liability under these Terms will not exceed the total amount paid by the Client for the services provided.
9. Termination
Either party may terminate the contract by providing notice in writing before commencement of works.
The Company reserves the right to terminate the contract immediately if the Client fails to comply with these Terms or if payment is not received.
Upon termination, the Client will be liable for all work completed up to the date of termination.
10. Force Majeure
The Company will not be liable for any delay or failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, or supply chain disruptions.
11. Dispute Resolution
Any disputes arising out of or in connection with these Terms shall be resolved amicably through negotiation.
If a resolution cannot be reached, the dispute may be referred to mediation or arbitration in accordance with the laws of England.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England. Any legal actions or proceedings arising from these Terms shall be brought in the courts of England.
13. Amendments
The Company reserves the right to amend these Terms at any time. Any changes will be communicated to the Client in writing and will take effect immediately upon such communication.
14. Entire Agreement
These Terms, together with any associated contract or quotation, constitute the entire agreement between the Company and the Client and supersede any prior agreements or understandings.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Additional Notes
Laminate Flooring: Clients are responsible for the removal of any laminate flooring that may need to be taken up during the works. Tide Electrical is not liable for any damage caused to laminate flooring during its removal.
Carpet Reinstallation: While every effort will be made to refit carpets after completion of works, Tide Electrical cannot guarantee that carpets will be reinstalled to the same standard as before they were taken up.
Earthing Disclaimer: All quoted works are based on the assumption that a satisfactory main earthing arrangement is present and complies with current regulations. If no earth is provided by the supply network or if the existing earth fails testing, additional remedial works or involvement from the Distribution Network Operator (DNO) may be required. Any associated costs for upgrading or installing a suitable earthing system are not included in this quotation and may be chargeable.
